good morning. thanks for being with us. i'm marla tellez. >> and i'm jon kelley. we start things off with breaking news in the east bay. fire crews battling a fire in san leandro. you can see all that gray smoke there just billowing into the air. a structure right now is burning on altamont road alongside 580. as of now, at this point it's unclear exactly what type of structure this is that's on fire. so far, no word of any injuries. we'll, of course, continue following this story and that fire and bring you any new information as we get it into our news room. we have new information this morning about the suspect who opened fire at l.a.x. on friday,

killing a tsa agent. authorities say the man text his brother before the shooting to say he was going to commit suicide. nbc's miguel almaguer has the new details. >> reporter: investigators say 23-year-old paul ciancia was dropped off by a friend in a black hyundai. he calmly walked inside terminal three with this assault rifle, plenty of ammo, a plan to kill, and a note for police. >> in that note, he indicated his anger and his malice, i would say, towards the tsa officers. >> reporter: according to a federal criminal complaint, ciancia fired multiple rounds at point-blank range at officer hernandez. investigators say ciancia then proceeded up an else canlator, but when the wounded officer appeared to move, he returned to the lobby, shooting hernandez again. >> we have a tsa officer shot. >> reporter: with hernandez down, the gunman is on the move. police say he shoots and wounds

t two more tsa officers. a high school teacher is also hit. once he was past security, police say the suspect made his way down this long corridor. according to some reports, he went up to witnesses and said, tsa? they shook their head no, the suspect kept going. in 60 seconds, police corner ciancia, shooting him multiple times and at least once in the head. >> suspect down, suspect down. >> reporter: we now know ciancia lived in los angeles for over a year. law enforcement sources tell nbc news he legally purchased two guns from a target range not far from his home. in a note, ciancia lashes out at the tsa saying his constitutional rights were being violated and calling himself a pissed off patriot. it also mentions nwo, a possible reference to the new world order, a conspiracy theory that warns of a totalitarian one-world government. ciancia reportedly sent his family back in new jersey an alarming text message just

before the rampage. his father was so worried, he asked local police to call l.a. authorities. >> i received a call from the father. he called my cell phone back and he said to me that, i can't believe what i'm seeing on tv. is this true? is this my son that's involved in this shooting? my reply to him was, i heard the same thing, paul, but i haven't confirmed anything yet. >> reporter: that confirmation would come later, most tragically for the family of the tsa agent hernandez. >> i am truly devastated. we are all heartbroken and will miss him dearly. >> that was nbc's miguel almaguer reporting. as of right now, ciancia is in critical condition and under 24-hour armed guards. we also want to mention that the family of ciancia is about to speak at a news conference. if you'd like, you can watch that live on our website. that's nbcbayarea.com.

well, the parents of the 13-year-old boy shot by a sonoma county sheriffs deputy holding a press conference a couple hours from now to talk about filing a civil rights lawsuit against the deputy and the county, claiming that shooting was simply unconstitutional. the lawsuit alleges the deputy shot andy lopez without reasonable cause and that is what violates the boy's fourth amendment. almost two weeks ago the deputy mistook that boy's replica rifle for a real life ak-47 and then shot him a total of seven times. the deputy claims the boy started to point that replica directly at him and the deputy says he feared for his life. in the south bay this morning, a suspect is in custody in connection to a deadly shooting in downtown san jose. this happened early yesterday morning on morrison avenue. police say a man in his 30s was shot at least once. family members drove him to the hospital where he was pronounced dead. in less than an hour, police say the suspect, who apparently knew his victim, was in custody.

>> maybe 4:30, 5:00 in the morning some shots were fired down here at the end of the block. maybe four or five. >> the shooting marks the city's 39th homicide this year. that's five more than san jose had at the same time last year. this morning san francisco police investigating a crash, a tragic crash that killed a man in a wheelchair. this happened overnight. it happened around midnight mere market street in octavia. so far, there's just very few details about this crash that have been released. the driver stayed at the scene, and it's unclear at this point if he or she will be facing any charges. the victim was a man in his 20s. >> the officers began to render aid. an ambulance responded, transported the victim to the hospital, where he was pronounced dead a short time later. >> just three days ago the city turned on a camera system at that very intersection. that intersection, we can tell

you, had the most injury collisions in that city just two years ago. in the east bay, walnut creek police say two burglaries over the weekend were committed by the same person. you can see in this surveillance video the burglar breaks a glass door saturday night at a thai restaurant. he then yanks the cash register out and runs off with it. the owner says $200 was inside. now, police officers say the yogurt shop in the same mall was also burglarized that night by an armed robber. in this case, the man pulled out a handgun and demanded money from the cashier. in these modern times, it's not unusual for high schools to have security cameras, but it is becoming more common as middle schools and elementary schools. at least one bay area county, the novato school district now installing cameras.

installation officially starts today, costing more than $120,000. just last year the district did spend $177,000 to install cameras at a couple of its high schools. the district now tells the journal it will not be putting cameras in any classrooms, bathrooms, or any other buildings. they'll just be featured on the outside of the buildings, pointing at entrances and corridors. a san francisco man charged with drawing a hammer at picketing bart workers will be in court today. the 49-year-old has pleaded not guilty to felony assault charges related to the october 21st attack. prosecutors say he hurled the hammer at striking workers, missing them by just about 15 feet. this happened outside the daily city station. he remains in custody on $25,000 bail. well, this one would be a unique twist on the ball yard. the bay area's two big league baseball teams could share a stadium next year. instead of the a's playing at

o.co coliseum, a new report out says the american leigh west champs might be hosting their home games at the home of the giants. that, of course, is at&t park. christie smith is live at the coliseum this morning. sounds like you had a chance to speak to one of those groups working to keep the a's over in oakland. >> reporter: yeah, that's right. good morning to you. you know, the a's two-year deal to temporarily play at at&t park could begin as early as next season. as you can imagine, fans here in oakland, people who support the team, they're not too thrilled with this idea. they say it would undercut everything that the city and supporters have done to keep the a's playing right here. >> the neighborhood keeps oakland alive. it keeps us together. they have one of the best tailgate parties you could ever see. a lot of good people coming out. it's more exciting when they're here. >> would you ride across the bay to see the a's play at at&t park? >> i mean, if you're going to go

do something, why not? >> reporter: major league baseball would help the team go across the bay if the coliseum doesn't come up with a short-term lease. that according to "the chronicle" this morning. the short-term lease could give the a's more flexibility for a move, say to san jose maybe. but the issues they can't agree on have to do with things you might not expect. revenue from food and drink sales here at the coliseum. even though these talks have gone on for more than two years, the president of the group save clabd sports, dedicated to keeping them here, think that a deal will probably be reached here in the east bay before squeezing all those games into one stadium. >> yeah, that would be a lot of games. it's not unprecedented to have teams share a venue while they look for long-term solutions. i just really don't think it's going to happen. there was discussion, what, 20, 30 years ago when the giants were looking at maybe moving that they would play at the coliseum for a little bit. i remember the mayor at the time

new at 11:00, four smolly men pleaded not guilty in a kenyan court today for allegedly helping the militants who attacked a nairobi shopping mall in september. all the men who appeared in court today were formally charged with commission of a terrorist act for their alleged involvement in the attack in which killed 64 people. the suspects are accused of offering support, providing shelter, and providing false documents to the gunmen from the somali islamist militant group.

few details have emerged about the master mind of the atablg. in egypt, a defiant mohamed morsi now reportedly on his way to prison in alexandria. the trial of the ousted egyptian president was adjourned just hours after it started in cairo this morning. while in court, morsi called himself the country's, quote, legitimate leader. and get this, he refused to wear a prison uniform or recognize the courts. morsi and 14 co-defendants are facing charges of inciting the killing of protesters who were against his rule. the judge postponed the hearing until january. now, a preview of an exclusive investigative unit report. too many flights and not enough pilots. that's what critics say is creating a safety problem in a lot of international flights. they point to a growing demand for international commercial

tech. twitter's proposed price released this morning. >> and we get closer and closer to that ipo. >> well, right. more money, right? good morning. we expect final pricing on wednesday. then the first trades to the public sometime thursday on the new york stock exchange. cnbc did take a poll, by the way, and found one in five americans use twitter. now, many don't post to twitter, but they do actively read it. 12% of americans really have no idea what twitter is. and then this one is my own statistic. this is the total profit twitter has made since it was created. it's absolutely zero. the twitter ipo is interesting, but it's really not very big. you want big. let's reach back to the ipo of san francisco's visa. 13 times bigger than twitter's expected ipo. the company raised nearly $18 billion. this is not just san francisco's biggest ipo, it's america's

biggest ipo ever. i think honestly if you stop the average person on the street in san francisco and said tell me about the biggest ipo, they'd say facebook, maybe reach back to netskcape. >> all right, scott. thank so much. nasa releasing new findings this morning from its ongoing keplar mission. >> and bob rydell is joining us live where they just announced some results. >> reporter: good morning. one of the missions of the space telescope is to answer that question, is earth this big piece of rock that we all happen to live on? is it unique, or is it possible there are other planets out there in an inhabitable zone just like this one? this morning, scientists who have been analyzing the data collected over the years by the telescope announced today they have discovered more than 800 new planets, 104 of those are in the inhabitable zone. that means they're not too close

to their son where they would be to hot and not too far from their son where they would be too cold, just like earth. they're in that sweet spot where it's just right temperaturewise. of that group, ten are considered earth size. >> so that's all we know about these planets. we don't know if they have atmospheres. we don't know if they have liquid water. we don't know if they have life at all. but future missions and future scientists will answer this question. i think they'll look back at keplar as an important milestone. >> reporter: the mission only identifies planets that could be like earth. it would take another mission to actually find out whether those planets are like earth, whether they have a breathable atmosphere, oceans, clouds, mountains, that sort of thing. today's announcement kicks off the second ever keplar science conference going on all week here, bringing together 400 confm+÷nce going on all week discuss the three years of data collected so far by the space telescope. there's still a year's worth of data that has yet to be amized.
